This Privacy Policy applies to the activities of Australian Dental Health
This policy explains how we handle personal information and comply with the Australian Privacy Principles in the Privacy Act 1988 (Cth) (“Privacy Act”).
This Privacy Policy does not apply to personal information collected by us that is exempted under the Privacy Act, for example employee records and/or information about companies or partnerships unless and to the extent that the disclosed is specific to identifiable individuals of the company or firm.
This Privacy Policy relates to the collection and use of personal information you may supply to us.
Unless we obtain your written consent, we will not sell, disclose, licence or rent your personal information to a third party for that third party’s marketing purposes.

Background

We provide dental and associated health care treatments and services to individuals. The nature of the services provided means that we may collect personal or sensitive information about our clients and patients, their employees (where applicable), their legal guardians or carers (for example, where our patient is under the age of 18 years of age) for the purpose of providing our services. If we are using, collecting or storing personal or sensitive information outside of the jurisdiction of Australia, we will comply with the privacy laws applicable to that jurisdiction.

Definitions

“Personal Information” means information that can be associated with a specific person and can be used to identify that person and includes your information. Information that has been made anonymous or aggregated so that it cannot be used, whether in combination with other information or otherwise, to identify a specific user is not personal information. Personal Information may include sensitive information, particularly Health Information.
“Health Information” means personal information or an opinion about your health, including an illness, disability or injury, (at any time), your expressed wishes about the future provision of health services to be provided to you, a health service provided or to be provided, or other personal information collected to provide, or in providing, a health service to you, in connection with the donation, or intended donation, by an individual of his or her body, or genetic information about you in a form that is, or could be, predictive of the health of the individual or a genetic relative of the individual.
“You”, “your”, “yours” includes, where the patient is under 18 years of age, includes any parent or legal guardian of the patient.

HOW WE COLLECT PERSONAL INFORMATION

We collect personal information in several ways, including:

  • When you interact with us by phone, electronically or in person.
  • When you use our web site or our social media.
  • When you subscribe to our publications

From third parties such as our service providers, government agencies third party healthcare or private health fund providers, operators of linked websites, applications and advertising on the website; and When we provide our services to you.

WHAT INFORMATION DO WE COLLECT AND WHY?

Patients/Guardians

  • We collect identity and contact details Your name, phone number, email address, physical address and other contact information.
  • Health and sensitive details (facts and opinion)- Data relating to your health care eligibility status e.g., Medicare registration, health care concessions and private health fund.
  • To deliver appropriate care and treatment to our patients and to let their next of kin know how they are doing- Information about the treatments or other services you have asked for and/or that we provide to you.
  • Some of this health information may come from a third party (e.g.: representative, hospital or referring doctor).
  • Patients can choose not to provide a specific detail, and this may reduce our ability to provide services – although we will always do our best regardless.
  • Records and content of consultations and communications with us or any other person including when using communication tools such as website/email/phone/social media.
  • Information from enquiries you have made.
  • Additional personal information we ask you to provide to verify your identity or when we suspect that you are in breach of our Terms of Service, this Privacy Policy or other Website policies (including your personal ID and your answers to any questions we pose to you).

HOW PERSONAL INFORMATION IS USED

Our principal purpose in collecting, using and storing your personal and/or health information is to provide you with our health care services. We may also collect your access to and use of our websites in a personalised, safe and efficient manner. You consent to us collecting, using, storing and sharing your personal information to:

  • Provide you with a service including a health care service.
  • Respond to requests or queries.
  • Notify you about changes to our services and industry developments.

  • For administrative purposes, including processing payment transactions and health fund or Medicare rebates.

If you do not provide us with the personal information we have requested, we may not be able to complete or fulfil the purpose for which such information was collected, including providing you with the services including health care services we were engaged to perform.

HOW CAN YOU ACCESS YOUR PERSONAL INFORMATION? WHO ELSE HAS ACCESS?

Patients

We disclose patient information for the primary purpose of providing a health and dental service

  • When we have the patient’s, or their representative’s, consent.
  • To other health professionals (in an emergency, this may be done without notice or express consent).
  • To our services providers who assist us to provide its services such as information technology providers and marketing advisers (including in relation to fee collection, fraud investigations and Website operations).
  • To comply with any applicable law, request by a governmental agency or regulatory authority or legally binding court order- when legally required.
  • To report to, or otherwise notify, the facility that is responsible for your care and who engages us to provide health care services and treatment to you and, where applicable any other legal guardian or carer responsible for your safety, health and wellbeing.
  • To protect the rights, property or personal safety of any member of the public.
  • Where we reasonably believe that the use or disclosure is reasonably necessary for prevention, investigation, prosecution and punishment of crimes or wrongdoings or the preparation for, conduct of, proceedings before any court or tribunal or the implementation of the orders of a court or tribunal by or on behalf of an enforcement body.
  • To our Government Funders
  • As de-identified data for research, compilation of statistics and public health
  • In some cases, ADH may share information with your child’s school, to support their safety, well-being and health. Information your school collects/receives in relation to the Australian Dental Health Initiative, will be used and managed in accordance with your child’s school privacy policy, which is available from the school.
  • To our directors, staff, contractors, professional advisers and related entities.
  • To third parties to whom you expressly ask us to send, or consent to us sending, your personal information.
  • To such entities that we propose to merge with or be acquired by and in such case, we will require that the new entity following the merger or acquisition adhere to this Privacy Policy.
  • You can access other personal information we hold about you by giving a written request which we will respond to within 10 business days. We will need to confirm your identity before providing access. There are some instances under the Act where we can deny a request such as impacting on another person’s privacy. If we deny a request, we advise the reasons in writing. Please note that information is not provided over the phone, unless we are certain the enquirer is the individual or the legal or nominated representative. If a detail we hold is incorrect or outdated, you can let us know at any time and we will change it. At times we may not agree to remove or change it (e.g.: medical opinion) but they can add separate information to the file.

We are committed to maintaining accurate, timely, relevant and appropriate information about our customers and web site users. HOW WE SAFEGUARD YOUR INFORMATION

We secure information by giving access to only the staff that need it for the primary collection purpose. Australian Dental Health uses a range of hardware and software security measures to protect your information. We keep all paper records safe – patient records are always kept with our clinical staff. All documentation is brought back to our bases and kept in locked storage. It is always sealed when being transferred. Information collected via our website, is stored securely in our databases and only accessed by authorised staff. We destroy or de-identify information not needed for the intended purpose as soon as we can; We ensure all our staff are aware of privacy expectations
Our services may be performed onsite or offsite. In the instances where we are required to work at your premises, we will take all due care and consideration to ensure no loss and/or damage occurs. However, we shall not be held responsible for any loss and/or damage incurred whilst at your premises.
Once we do receive your transmission, we will also make our best efforts to ensure its security on our systems.
We also require our employees and data processors to respect the confidentiality of any personal information held by us.

SOCIAL MEDIA

Our web sites may contain links to other web sites such as social media pages (e.g., Facebook) and those third-party web sites may collect personal information about you.
